Auction Terms & Conditions

These Auction Terms and Conditions apply exclusively to all auctions conducted through this website. By registering, placing a bid, or participating in any auction, you agree to be bound by these terms in addition to our general Terms of Use and Privacy Policy.

Please note that all auction items are sold as-is, with no customer service, support, or post-sale communication provided. Auctions are fully automated, and all bids, purchases, and outcomes are final.

1. Eligibility
You must be 18 years or older to bid.

By bidding, you affirm that you are legally capable of entering into binding agreements.

2. Auction Process
All auctions are final. Bids cannot be retracted. Auctions are automated and customer service arrangements are extremely limited on auction items.

Each bid is a legally binding offer to purchase the item if you win the auction.

The highest bidder at the close of the auction wins the item and must finalize the purchase.

3. Payment and Shipping
The final winning bid does not include shipping. Shipping costs will be calculated and added to the total invoice after the auction ends. Shipping cannot be combined on multiple winning auctions. Take shipping costs into consideration before placing your auction bid.

Full payment must be made within 48 hours of the auction closing. Payment options and instructions will be provided at checkout. Failure to pay promptly may result in a restriction from future bidding on other items.

No discounts gift cards or other promotional options and no discount codes are available on any auction item in the payment process. Auction items are heavily discounted already.

4. Failure to Finalize Purchase
If a winning bidder fails to complete the purchase without prior written approval from the Opal Whisperers team, their account will be suspended from all current and future auctions.

Reinstatement is only possible upon written permission from the Opal Whisperers and may require proof of intent or payment in arrears.

5. Opal Whisperers Recommended Retail Price (OWRRP)
Any mention of OWRRP (Opal Whisperers Recommended Retail Price) is for guidance only. It does not reflect a market appraisal or guarantee of value. Our OWRRP prices are based on prices at which the product, or a comparable item, was (or in the future could be) offered for sale by Opal Whisperers, marketplace sellers, suppliers, or other retailers or e-commerce companies.

6. Bidding Conduct
The use of multiple accounts to influence price is strictly prohibited and may result in immediate banning.

The site reserves the right to cancel any bid or listing if fraudulent, malicious, or suspicious activity is detected.

7. Returns and Disputes
All sales are final unless otherwise stated. Please review listing descriptions and images carefully before bidding.

Any dispute or request related to an auction item must be made through the website.

For EU customers, auction items sold through this website are intended to be excluded from the EU 14-day right of withdrawal where the applicable auction-sale or public-auction exception applies. By registering for an auction, placing a bid, or completing an auction purchase, you acknowledge that auction bids are binding, auction purchases are final, and that you will not have a 14-day cooling-off or withdrawal right for auction items to the fullest extent permitted by applicable law. This does not affect any statutory rights that cannot be excluded, including rights relating to faulty, damaged, incorrect, or misdescribed goods.

No refunds or exchanges are available on auction items except where required by applicable law, including for faulty, damaged, incorrect, or misdescribed goods.

8. Reserve Not Met
If an auction ends without meeting the reserve price, the item will not automatically be sold.

However, Opal Whisperers may, at their discretion, contact the highest bidder(s) with an off-market offer.

There is no obligation on either party to proceed with such an offer, and it will be handled separately from the auction platform.

9. Account Suspension and Enforcement
We reserve the right to suspend or terminate accounts for violations of these terms, with or without prior notice.

This includes repeated non-payment, feedback manipulation, or any action that undermines the integrity of the auction platform.

10. Moderation and Authority
The Opal Whisperers act as the sole moderators of auction conduct, dispute resolution, and reinstatement requests. Their decisions are final.

We aim to provide a fair, transparent, and respectful auction experience for all users.

11. Changes to These Terms
These Auction Terms may be updated from time to time. Continued participation in auctions after changes constitutes acceptance of the revised terms.

Make an Offer — Terms & Conditions

By submitting a “Make an Offer” on an item through our website, you agree to the following terms and conditions.

1. Making an Offer

Submitting an offer does not constitute a purchase or guarantee that the item will be sold at the amount offered. All offers are subject to review and acceptance at the sole discretion of Opal Whisperers.

We reserve the right to accept, reject, or counter any offer without providing a reason.

2. Offer Acceptance

An offer is only considered accepted once you have received confirmation from us that your offer has been accepted.

Until an offer has been formally accepted by the store, the item may remain available for purchase by other customers. We do not guarantee that an item will be held while an offer is being reviewed.

3. Counter Offers

We may choose to respond to an offer with a counter offer. A counter offer is not binding until accepted by both the customer and the store.

4. Payment

If your offer is accepted, you may be required to complete payment within the timeframe specified by the store. If payment is not received within the required timeframe, we reserve the right to cancel the accepted offer and make the item available for sale again.

5. Shipping

All accepted offers are subject to our standard Shipping Policy, including applicable shipping charges, delivery timeframes, exclusions, and other shipping conditions.
Accepted offer orders cannot be combined with other offers, auctions, or purchases and must be paid and have shipping calculated at checkout.

Unless otherwise agreed in writing, shipping costs are not included in the offer price and will be calculated and applied at checkout.

6. Product Availability

Opals and other one-of-a-kind or limited-availability products may be sold to another customer before an offer is accepted. We reserve the right to withdraw an item from the “Make an Offer” process at any time.

7. Pricing & Discounts

An accepted offer applies only to the specific item for which the offer was submitted. Offers cannot be transferred to another product or combined with other discounts, promotions, coupons, or special offers unless expressly agreed by the store.

8. Errors & Changes

We reserve the right to correct pricing, listing, description, availability, or technical errors and to cancel or withdraw an offer where an error has occurred.

9. No Obligation to Accept

We are under no obligation to accept any offer, regardless of the amount offered. All offers are considered individually and are accepted at the store's discretion.

10. General Terms

Our standard Terms & Conditions, Shipping Policy, Returns & Refunds Policy, and any other applicable website policies also apply to purchases made following an accepted offer.
